Draft law on reducing congestion and providing housing to ger areas developed

At the Cabinet meeting, Governor of the Capital city and Mayor of Ulaanbaatar Kh.Nyambaatar presented the primary draft law on reducing traffic congestion in Ulaanbaatar city and providing housing to ger areas. He presented to the members of the cabinet that a bill to amend 27 laws to accompany this draft law was prepared. In this regard, the Mayor gave information to media.

Legal framework for selling, pledging, and gifting the license plates to be created for citizens

Forty-three percent of the total population of Mongolia lives in Ulaanbaatar, which covers 0.03 percent of the total territory. The number of vehicles registered in the capital is 680,000. In 2022, 99,000 vehicles imported through the customs, 94,000 of which were registered in Ulaanbaatar. As of the first nine months of this year, 90,000 vehicles were imported, of which 86,000 are in traffic in Ulaanbaatar. It's evident that despite the annual investments made by both the state and the capital city to expand Ulaanbaatar's road network, it struggles to keep pace with the influx of imported cars. Even if several hundred kilometers of roads are constructed, it may not be sufficient to alleviate traffic congestion. Therefore, as part of the measures to be taken in the future, a cap on the issuance of license plates will be determined based on the capacity of Ulaanbaatar's road network. This decision will be ratified by the Citizens’ Representative Khural. Additionally, a legal framework will be established to enable citizens who presently own license plates to sell, pledge, or gift them to others.

Unplanned and disordered construction in Ulaanbaatar to be restricted

In Ulaanbaatar, regulations are being introduced to restrict the construction of unplanned and disordered buildings. Since 2000, certain works have been carried out within the framework of housing the ger areas. However, residential areas around the "Nature" center, Yarmag, and the Dulguun Nuur have turned into unplanned and non-standard concrete jungles. Therefore, it is necessary to establish the construction and general plan of Ulaanbaatar city, as well as housing standards and norms that are suitable for them. In this context, the draft law and its accompanying laws incorporate regulations to oversee construction projects involving more than 1,500 units. These regulations pertain to architectural planning, granting assignments and permissions to commence construction, as well as relocating projects to areas covered by the general plan.

The allocation of 0.04 and 0.07 hectares of land to be stopped in six central districts

It has been decided to completely stop allocating 0.07 and 0.04 hectares of land for residential and camping purposes by the order of the capital and district governors in this law and the accompanying laws. In other words, the legal regulation of land allocation by the governors of the six central districts are being restricted. The land allotment process will continue for the three peripheral districts.

One mistake in procurement is that it is done only at the level of government agencies. Therefore, some positions in the procurement agencies and departments of the capital and district will be eliminated, and the work of developing standard tender documents will be transferred to professional associations in the new law and accompanying laws. Evaluation committees will be selected according to the tender documents and mutual monitoring will be created.

All major projects and programs have stagnated due to land vacation. Therefore, changes are included in the draft law to regulate relations related to land vacation. In cases where over 65 percent of the citizens and businesses in the affected area express support, the government will promptly address land vacancy concerns and provide compensation accordingly.

Regrettably, numerous citizens who had to vacate their land for redevelopment have suffered the loss of their homes, with little progress on the promised work. Therefore, the city will offer three options to citizens and businesses in a integrated manner, and if more than 65 percent supports, land vacation will be carried out. These options include: First, offering citizens the choice to sell their land at a standard price or in cash, second, allowing them to relocate to temporary apartments, with the eventual ownership of the newly constructed apartments in the vacated area, and third, to exchange their land and objects for pre-built apartments.

Public transport standards, as well as legal regulations for the introduction of major types of public transport, such as the subway, and related relations are included. The project of fundamental changes, including how to form the public transport fund and what it will be used for, was presented at the Cabinet meeting. In this regard, after taking views from the ministries and including certain proposals, the primary law and accompanying bills will be discussed at the Cabinet meeting in accordance with the relevant regulations and submitted to the Parliament in the near future.
